State Representative Jerry Neyer has proposed legislation aimed at reducing insurance costs for businesses in Michigan by reinstating the 'Open and Obvious' doctrine. This legal standard, which was abolished by the Michigan Supreme Court in 2023, previously protected property owners from liability cases involving apparent hazards.

Rep. Neyer highlighted the impact of the doctrine's removal on businesses, stating that without it, they face "overwhelming insurance rates due to increased legal actions and general uncertainty." He emphasized the need for a predictable legal framework, asserting that "businesses shouldn’t be sued because somebody lacks common sense."

House Bill 4582, introduced by Neyer, seeks to lower liability insurance costs for small businesses across the state through the Commercial Premises Liability Act. The bill aims to reinstate a balanced approach where property possessors are not obligated to protect invitees from obvious dangers.

The proposed legislation has been referred to the House Judiciary Committee for further consideration.
